Programme Requirements

To qualify for the US EB-5 Immigrant Investor Program, you must fulfil ONE of the following investment options AND other requirements:

OPTION 1. Create a New Business
  • Invest at least $1,050,000 USD into the business which can be reduced to $800,000 if investing in a designated Targeted Employment Area
  • Create at least 10 full-time employment positions
  • The business must benefit the US economy by providing goods or services to US markets
  • You must be involved in the day-to-day management of the business
OPTION 2. Invest Passively in a Regional Center

An EB-5 Regional Center is an economic unit, public or private, in the US, involved with promoting economic growth. As with option one, this starts from $800,000 USD. While there are over 700 Regional Centers, many do not have active projects nor are they in compliance under the new regulations so it is important to select the right one. Application Process

  • MONTHS 1-2

    Client onboarding begins

    We commence our process with Form 1. This enables us to carry out the initial RIF Trust, part of Latitude Group, due diligence. Following the successful screening, we will provide you with a Client Agreement (CA) to review and sign. At this stage, we will also recommend a US EB-5 immigration attorney to assist with the overall process.

    You will also be required to select a qualifying investment. For those interested in a Regional Center (passive investment option) it is important to consider those with a successful track record history associated with EB-5 projects. Latitude will help guide an EB-5 investor through the selection process.

    The legal team will complete all necessary government forms and supporting documents. They will closely liaise with United States Citizenship and Immigration Services (USCIS) to comply with the programme parameters.

  • MONTH 3

    Application review and submission

    Before submitting your documents, we comprehensively rereview your application to ensure that it meets all the specific requirements of the EB-5 Investor Programme.

    The legal team will submit the relevant forms to USCIS. The government undertakes its own due diligence and studies all the paperwork

  • MONTHS 3-27

    EB-5 Investor Petition processing

    USCIS processes the EB-5 Investor Petition. Depending on the volume of applications, this can take between a few months and a couple of years.

  • MONTH 27

    Obtaining a provisional Green Card

    We complete the form for you and your family to receive conditional permanent residency visas. This is filed with USCIS.

  • Months 30-36

    Receiving residency

    USCIS issue you your conditional permanent residency visas. These become unconditional. Once they do, you become eligible to apply for US citizenship.

Once you’ve submitted your I-526 immigration petition, the US EB-5 Investor Visa processing time can last between 29 and 61 months, according to the most recent US Citizenship and Immigration Services (USCIS) estimates.

You’ll be required to make a minimum investment of US$800,000 in a Targeted Employment Area – rural areas or areas with an unemployment rate of at least 150 percent of the national average.

You can also make a minimum investment of US$800,000 in a Regional Centre (pre-approved by the USCIS) or make a minimum investment of US$1.05 million in a new commercial enterprise.

After five years of legal residence within the country, you will be eligible for US citizenship. This is only available to those who have upheld their residency status, as per the requirements and considerations.
